[ARCHIVED] Proposed Charter Amendment No. 2 to be considered at the November 2, 2010 Election.

Shall Sections 11.01 and 11.04 of Article XI of the Charter of the City of Fairlawn be amended so as to create an alternate member for the Board of Zoning and Building Appeals.

PROPOSED CHARTER AMENDMENT NO. 2
City of Fairlawn
A Majority Affirmative Vote is Necessary for Passage

Shall Sections 11.01 and 11.04 of Article XI of the Charter of the City of Fairlawn be amended so as to create an alternate member for the Board of Zoning and Building Appeals.

That the proposed amendment to the Charter of the City of Fairlawn amending and/or supplementing Article XI, Sections 11.01 and 11.04, be adopted so that as amended and/or supplemented the Sections 11.01 and 11.04 of Article XI shall provide as follows:

ARTICLE XI
“BOARD OF BUILDING AND ZONING APPEALS”

SECTION 11.01. COMPOSITION AND TERM.
The Board of Zoning and Building Appeals shall consist of five (5) regular members and one (1) alternate member all of whom shall be electors of the Municipality not holding other Municipal office in the Municipality. The five (5) regular members and one (1) alternate member shall be appointed by the Mayor with confirmation by Council.
The term of the members of the present Board of Zoning Appeals shall terminate on January 2, 1972. Of the five (5) regular members to be appointed for the term beginning January 2, 1972, one shall be appointed for a term of one year, one for a term of two (2) years, one for a term of three (3) years, one for a term of four (4) years and one for a term of five (5) years. Beginning January 1, 2011 the one (1) alternate member shall be appointed for a term of five (5) years. Thereafter, each appointment shall be for a term of five (5) years.
A vacancy occurring during the term of any regular or alternate member of the Board of Zoning and Building Appeals shall be filled for the unexpired term in the manner authorized for an original appointment.
SECTION 11.04. MEETINGS AND PROCEDURE.
The time of meetings and the procedure before the Board of Zoning and Building Appeals shall be as provided by ordinance of Council or rules or regulations established by the Board not inconsistent therewith. Meetings shall be open to the public and a record shall be kept showing the vote of each member on each question.
The alternate member shall participate in any regular or special meeting of the Board when a regular member is unable to attend and shall have full authority in participation and voting in matters that come before the Board at that time.
