In September, 2004, the City of Fairlawn’s ability to regulate the drilling of oil and gas wells within the city limits was preempted by the Ohio legislature when it amended Ohio Revised Code Section 1509.02.
The amended section directs that Ohio’s Department of Natural Resources Division of Mineral Resources shall have the exclusive right and authority to regulate all oil and gas well drilling throughout the State.

Although we have been advised that the drilling process will take approximately three weeks, we regret that we are powerless to regulate it in any manner.
